Civil disputes are those that arise between private individuals, such as neighbours or road users. Disputes between companies, firms and sole traders are called commercial disputes because they involve businesses and traders. These arise out of boundary disputes, property disputes, such as interference with goods, and nuisance disputes. At a mediation there is little difference between the process followed with each of these. But they differ because of the motivations behind them. Commercial mediations are more likely to be motivated by concerns about reputational damage in litigation and opportunity losses of spending months building a legal case when that time could be better spent generating profits (often of greater value than what is at stake in the current dispute).
