“What if I change my mind about the Settlement Agreement I sign at the end of a mediation?”
Your signed Settlement Agreement is a contract which binds you and the other participant to perform the promises contained in it. In very rare cases, parties agree to a cooling-off period to enable a change of mind. In others, a contract can generally be varied by subsequent agreement (for example where both parties recognise the need to add some practical step that they overlooked during their drafting). But if it is only you who are unhappy, your only hope of being released from your contractual promises is to rely on one of the legal mechanisms that will enable the contract to be impeached. This hardly ever happens. To guard against this undesirable event it is critical that you take legal advice.
