“How will my lawyer help me while mediating with you?”

Your lawyer is there to keep an eye on your interests. A good lawyer will vigilantly consider what information can safely be divulged to the other participant and will help you to consider the value of offers received. If the other participant’s lawyers decide to rely on legal points, your own lawyer will advise you on whether they are applying that law correctly and how much they may be relying on bluff.

Note that before engaging a lawyer for your mediation you should check that they have experience of attending mediations. The person who attends with you may be the solicitor you instructed, or a barrister instructed by them. Either way, they will preferably be accredited as a Mediation Advocate. They will enable you to get the most out of the process.
