Civil Mediation

Civil mediations aim to end disputes between private individuals or one private individual and an organisation. These disputes are sometimes driven by a sense of grievance that has become deeply personalised.

In the most successful civil mediations a relationship is repaired, even allowing recovery of a friendship. However, for most people the value is contained in reaching the psychological closure which accompanies the signing of a Settlement Agreement. While airing opposing points of view and revealing impacts suffered, sometimes over many years, participants are accompanied by the mediator through a protected, safe conversation. A wish to end the dispute may be the only thing that the participants think they have in common when they arrive on mediation day. But the game-changing effect of the process is that shared interests often emerge as the day progresses.

Civil mediations arise in many contexts including Property, Boundary disputes, Inheritance, Professional Negligence, Probate/Wills and debt or damages claims between independent contractors and Consumers. It makes no difference whether there are already legal claims running between the participants. If there are, they will agree to end those claims along with the dispute that prompted them, incorporating an agreement of whether each are to pay their own legal costs, or some other arrangement.
